GENERAL CONDITIONS OF ACCOUNT'S OPERATION WITHIN MCP FINANCE
Article 1: Purpose and Opening of an Account
Article 1-1: Purpose
The purpose of these general conditions is to define the operating procedures for accounts opened with MUTUELLE COMMUNAUTAIRE DU PARTICULIER (hereinafter referred to as MCP).
Article 1-2: Opening of an account
Any member wishing to open an account must provide the required documents (ID, proof of address, etc.) and complete the necessary forms. Account opening is subject to the acceptance of MCP.
Article 2: Operation of the Account
Article 2-1: Depositaries
Deposits may be made in cash, by cheque, transfer or any other means accepted by MCP. Funds are available after verification and collection.
Article 2-2: Withdrawals
The account holder or a duly authorized person, within the limit of the available balance and in accordance with the terms defined by MCP, may make withdrawals.
Article 2-3: Account statements
MCP makes periodic account statements available to the member, either electronically or in paper form. The member is responsible for verifying the accuracy of transactions recorded on the statements and to report any anomalies within the prescribed time limits.
Article 2-4: Means of payment
MCP provides payment methods (cheques, credit cards, etc.) according to the specific conditions of each product. The member must use these means in accordance with the instructions and restrictions imposed by MCP.
Article 3: Responsibilities and Obligations of the Member
Article 3-1: Accuracy of the information
The member agrees to provide accurate and up-to-date information when opening the account and to inform MCP of any changes in his or her contact details or situation.
Article 3-2: Use of the Account
The member agrees to use the account in a manner consistent with applicable laws and the conditions set out by MCP. Any misuse or fraudulent use may result in the account being closed and legal action taken.
Article 3-3: Security
The member is responsible for the security of his payment methods and access codes. In the event of loss or theft, he must immediately inform MCP to block unauthorized operations.
Article 4: Fees and Pricing
Article 4-1: Management fees
The account is subject to a management fee, the amount and terms of which are defined in the MCP’s fee schedule. These fees are charged periodically from the account.
Article 4-2: Commissions and Interests
MCP may charge fees on certain transactions and pay interest on credit balances according to the specific conditions of each type of account.
Article 5: Closing of the Account
Article 5-1: Initiated by member
The member may request closure of their account at any time, subject to settlement of outstanding balances and charges.
Article 5-2: Initiated by MCP
MCP may close an account in the event of non-compliance with the terms and conditions, suspicious activity or any other legal or regulatory reason. Notice will be given to the member, except in case of fraud or emergency.
Article 6: Confidentiality and Data Protection
Article 6-1: Confidentiality
MCP undertakes to respect the confidentiality of information relating to the account and its holder, except where there is a legal obligation to disclose.
Article 6-2: Data protection
The personal data of the member is processed in accordance with the applicable data protection regulations. The member has the right to access, correct and delete his personal data.
Article 7: Disputes and Claims
In the event of a dispute or complaint, the member may contact MCP customer service. If no solution is found, the member may refer the matter to the competent authorities.
Article 8: Applicable Law
Cameroonian law governs these general conditions. Any dispute relating to their interpretation or execution will be submitted to the courts of Dschang, the registered office of MCP.
Article 9: Miscellaneous
MCP may amend these terms and conditions at any time. Changes will be notified to the member by any appropriate means. The maintenance of the account by the member after notification is deemed acceptance of the new terms.
